Cancellation policy for hosted accounts:

Setup fees are nonrefundable. If you choose to pay monthly, you may cancel your account at any time. If you choose to pay yearly, you may also cancel at any time. All periodic charges (that is, monthly, semi-annually, annually, etc.) or charges for prepaid plans are to be paid in advance and are non-refundable. This includes all setup and service fees. No prorated refunds will be given for fees paid in advance.

We provide web hosting to many clients, and we have a responsibility to protect each client and to provide the best services available. The following guidelines were designed to ensure these obligations are met.


Content:

All services provided may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party.


Pornography and sex-related merchandising is prohibited on all our servers. This includes sites that may infer sexual content, or links to adult content elsewhere. We will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated software
• Hacker programs or archives
• Warez sites

We will be the sole arbiter as to what constitutes a violation of this provision.


Commercial Advertising - Email:

Spamming, or the sending of unsolicited email, from our server or using an email address or domain that is maintained on our machine as reference is STRICTLY prohibited. We will be the sole arbiter as to what constitutes a violation of this provision.


Background Running Programs

We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.


IRC

We currently do not allow IRC or IRC bots to be operated on our servers.


Server Abuse:

Any attempt to undermine or cause harm to a server, or customer is strictly prohibited.


Refusal of Service:

We reserve the right to refuse, cancel, or suspend service at our sole discretion.

All Sub-Networks, distributive hosting sites and dedicated servers must adhere to the above policies.

Failure to follow any term or condition will be grounds for immediate account deactivation.

Registration Agreement

1. Fees

   As consideration for the domain name registration and web hosting services provided by 711.NET, Inc., you shall pay all applicable initial registration fees and renewal fees. At the renewal date of your services, it is your responsibility to ensure that all fees are paid. To find out the renewal date of your domain name you can do a whois lookup at the following site: http://www.nsiregistry.com. If you choose to cancel your domain name or yearly web hosting package, you are required to do this 30 days before the yearly anniversary date of your registration to avoid charges being placed on your account. Submit this request by clicking here. You may cancel a monthly hosting account at any time using the same form. You agree that 711.NET, Inc. may cancel or reassign the domain name in the event of delinquency.
   
   

2. Use Of Your Information

   We require that you provide and update certain information. This information includes your name, organization or business name, email address, mailing address, telephone number, and credit card information. You are fully responsible for updating all of this information. You acknowledge that 711.NET, Inc. will make some of the information that you provide during the registration process publicly available as required by ICANN (Internet Corporation for Assigned Names and Numbers).
   
   

3. Use Policies

   711.NET, Inc. reserves the right to suspend or cancel your hosting account in the event that you use the hosting account to send unsolicited commercial advertisements in contradiction to either applicable laws or customary acceptable usage policies of the Internet, or if you use your web site in connection with any unlawful activity.
   
   

4. Agents and Licenses

   You agree that, if your domain name is registered on your behalf by anyone acting as your agent (e.g., an Internet Service Provider, employee, etc.), you are bound by all terms and conditions provided herein.
   
   

5. Limitation of Liability

   You agree that 711.NET, Inc. or 711host.com will not be liable to you or any other person for any loss that may occur due to (a) any loss of registration of a domain name, (b) the use of your domain name, (c) access delays or access interruptions to 711.NET, Inc.’s registration system; (d) the non-delivery or mis-delivery of data between you and 711.NET, Inc.; (e) events beyond 711.NET, Inc.'s control; (f) the processing of this application; (g) the processing of any modification to the record associated with your domain name, (h) the failure of you or your agent to pay any fees hereunder; or (i) the application of the dispute policy. Further, 711.NET, Inc. will not be liable for any indirect, special, incidental, or consequential damages of any kind (including lost profits) regardless of the form of action whether in contract, tort (including negligence), or otherwise, even if 711.NET, Inc. has been advised of the possibility of such damages. In no event shall 711.NET, Inc.'s maximum liability exceed the total amount paid by you to 711.NET, Inc.
   
   

6. Breach and Revocation

   Any breach by you of the Agreement must be remedied by you within 30 days of notice by 711.NET, Inc. If you fail to cure the breach, 711.NET, Inc. may revoke your registration of the domain name and / or hosting package.
   
   

7. Governing Law

   This Agreement shall be governed by the laws of the State of North Carolina. Any action relating to this Agreement or to your use of the 711host.com web site shall be brought exclusively in the courts of North Carolina in the USA.
